Asylum claims and refugee status in Canada:

Canada’s asylum system, governed by the Immigration and Refugee Protection Act (IRPA), allows individuals facing persecution to claim refugee status at a port of entry or from inside the country.

Claims are heard by the Refugee Protection Division (RPD) of the Immigration and Refugee Board. RPD hearings are currently scheduled approximately 18 to 24 months after the referral date, with Refugee Appeal Division (RAD) appeals adding a further 6 to 12 months.

The federal Start-Up Visa Program requires a minimum investment of CAD $75,000 from a designated venture capital fund, CAD $200,000 from an angel investor group, or a letter of support from a designated business incubator.

Additional pathways include Owner-Operator LMIA routes and Provincial Nominee entrepreneur streams.

Students planning to study in Quebec must meet separate and higher proof-of-funds requirements set by MIFI before applying to IRCC. After graduation, eligible students can apply for a Post-Graduation Work Permit (PGWP), which requires completing a program of at least 8 months at a PGWP-eligible DLI; the permit duration matches the program length, up to a maximum of 3 years.

Since November 1, 2024, PGWP applicants must also provide a language test result – CLB/NCLC 7 for degree graduates and CLB/NCLC 5 for non-degree graduates.

Non-degree graduates must additionally confirm their program falls within an IRCC-approved field of study linked to long-term labour shortages. Many graduates transition to permanent residence through Express Entry or Quebec’s PEQ.

Processing times vary by stream: high-wage positions currently average 8 to 12 weeks; low-wage positions average 12 to 16 weeks.

The Global Talent Stream targets 10 business days for employers hiring in eligible high-skill sectors. The employer application fee is CAD $1,000 per position.
